Terms of Service for ReMotion

1. Introduction

Welcome to ReMotion ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the ReMotion mobile application (the "App"), backend services, and related services (collectively, the "Service") provided by SIA ByteMind, a company registered in Latvia ("Company," "we," "our," or "us").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

3. Description of Service

ReMotion is a mobile application that allows users to:

  • Upload and process photographs
  • Generate animated video clips from photographs using artificial intelligence
  • Combine multiple animated clips into a single video
  • Add music and text overlays to videos
  • Export and share completed videos

The Service operates on a subscription-based model with a monthly credit system for generating animations.

3.1 Backend Services

The App connects to backend services hosted on Vercel that provide:

  • AI-powered image animation processing using third-party AI providers (Replicate, Fal.ai)
  • Credit management and allocation system
  • Subscription verification and credit synchronization via RevenueCat REST API
  • Secure storage and processing of user-uploaded images
  • Job queue management for animation generation
  • Rate limiting and abuse prevention

4. Acceptance of Terms

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

5. Eligibility

You must be at least 13 years old (or the age of majority in your jurisdiction, whichever is higher) to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

6. User Accounts

6.1 Account Creation

  • You may be required to create an account to use certain features of the App
  • You are responsible for maintaining the confidentiality of your account information
  • You agree to provide accurate, current, and complete information during registration

6.2 Account Security

  • You are responsible for all activities that occur under your account
  • You must immediately notify us of any unauthorized use of your account
  • We are not liable for any loss or damage arising from your failure to protect your account credentials

6.3 Backend Account Management

  • Your account information is stored and managed through our backend systems
  • Account authentication is handled through secure API tokens
  • We use RevenueCat to manage subscription status and user identification
  • Your app user ID (from RevenueCat) is used to track credits and usage across our backend services

7. Subscription and Payment Terms

7.1 Subscription Model

  • ReMotion operates on a monthly subscription basis
  • Subscriptions are managed through Apple's App Store and processed by RevenueCat
  • Subscription fees are charged monthly in advance

7.2 Credit System

  • Subscriptions include a monthly allocation of credits
  • Each photo animation generation requires 1 credit
  • Credits reset monthly with your subscription renewal
  • Unused credits do not carry over to the next month
  • Monthly credit capacity is limited and subject to availability

7.3 Backend Credit Management

  • Credits are stored and managed on our backend servers using Upstash Redis
  • Credit allocation is processed server-side and synchronized with RevenueCat subscription status
  • Credit spending is enforced atomically on the backend before AI generation begins
  • Credit balances are verified server-side for each animation request
  • Daily spending limits and monthly capacity limits are enforced on the backend

7.4 Payment Processing

  • All payments are processed through Apple's App Store
  • Subscription fees are charged to the payment method associated with your Apple ID
  • Prices are displayed in your local currency and may vary by region
  • You authorize Apple to charge your payment method for subscription fees

7.5 Subscription Renewal

  • Subscriptions automatically renew at the end of each billing period unless cancelled
  • You will be charged the subscription fee at the beginning of each renewal period
  • We will notify you of any price changes before they take effect

7.6 Cancellation and Refunds

  • You may cancel your subscription at any time through your Apple ID account settings
  • Cancellation takes effect at the end of the current billing period
  • You will continue to have access to the Service until the end of the paid period
  • Refunds are subject to Apple's refund policy and applicable law
  • We do not provide refunds for partially used subscription periods

7.7 Free Trial

  • If offered, free trials are subject to the terms specified at the time of enrollment
  • You may be required to provide payment information to start a free trial
  • If you do not cancel before the trial ends, your subscription will automatically begin

8. Monthly Credit Capacity

8.1 Capacity Limitations

  • To maintain service quality and reliability, ReMotion limits the total number of photo animations that can be generated each month
  • When monthly capacity is reached, new subscriptions may be temporarily unavailable
  • Existing subscribers may experience delays in credit allocation when capacity is full

8.2 Backend Capacity Enforcement

  • Monthly credit capacity is enforced on our backend servers
  • Capacity limits are tracked per month using server-side storage (Redis)
  • Credit allocation is checked atomically before granting credits to prevent exceeding monthly limits
  • The backend verifies available capacity before allowing new subscriptions to receive credits
  • Capacity resets automatically at the start of each new month on the backend

8.3 Capacity Full Scenarios

  • If you subscribe when monthly capacity is full, your subscription will be active, but credits may not be immediately available
  • Credits will be allocated automatically when new capacity becomes available
  • We reserve the right to limit or suspend new subscriptions during high-demand periods
  • The backend will return appropriate error messages when capacity is reached

9. User Content

9.1 Your Content

You retain ownership of all photographs, videos, and other content you upload to the App ("User Content").

By uploading User Content, you grant us a limited, non-exclusive, worldwide license to:

  • Process and store your content to provide the Service
  • Generate animations and videos as requested
  • Store your content on our servers for the duration necessary to provide the Service

9.2 Backend Content Processing

  • User-uploaded images are transmitted to our backend servers for processing
  • Images are temporarily stored on our backend infrastructure (Vercel Blob Storage) for processing
  • Images are processed by third-party AI providers (Replicate, Fal.ai) to generate animations
  • Processed content is stored temporarily on our servers and third-party AI provider servers
  • We do not permanently store your images after processing is complete
  • Generated videos are stored on third-party AI provider CDNs and accessible via URLs

9.3 Content Restrictions

You agree not to upload, post, or transmit any User Content that:

  • Violates any law, regulation, or third-party right
  • Infringes on intellectual property rights
  • Contains offensive, harmful, or inappropriate material
  • Violates privacy rights of others
  • Contains malware or malicious code

9.4 Content Removal

  • We reserve the right to remove any User Content that violates these Terms
  • We may suspend or terminate your account for repeated violations
  • We are not obligated to store or maintain your User Content beyond what is necessary to provide the Service
  • Backend systems automatically clean up temporary files after processing

10. Intellectual Property

10.1 Our Rights

  • The App, including its design, features, and functionality, is owned by SIA ByteMind
  • All trademarks, logos, and service marks are our property
  • The AI technology and algorithms used to generate animations are proprietary
  • Backend infrastructure, APIs, and server-side code are proprietary

10.2 Limited License

  • We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes
  • You may not copy, modify, distribute, or create derivative works of the App
  • You may not reverse engineer, decompile, or disassemble the App
  • You may not attempt to access or reverse engineer our backend APIs or services

11. Prohibited Uses

You agree not to:

  • Use the App for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to the App, backend services, or its systems
  • Interfere with or disrupt the Service, backend servers, or infrastructure
  • Use automated systems to access the Service or backend APIs without permission
  • Share your account credentials or API tokens with others
  • Resell or redistribute the Service or any part thereof
  • Use the Service to create content that violates third-party rights
  • Attempt to bypass rate limits, credit limits, or capacity restrictions enforced on the backend
  • Make excessive API requests that may overload our backend infrastructure

12. Service Availability and Modifications

12.1 Availability

  • We strive to maintain Service availability but do not guarantee uninterrupted access
  • The Service may be temporarily unavailable due to maintenance, updates, or technical issues
  • Backend services may experience downtime due to third-party provider issues (Vercel, Replicate, Fal.ai, Upstash, RevenueCat)
  • We reserve the right to modify, suspend, or discontinue any part of the Service at any time

12.2 Backend Infrastructure

Our backend services are hosted on Vercel's serverless infrastructure.

We use third-party services including:

  • Vercel: Hosting and serverless functions
  • Upstash Redis: Credit storage and rate limiting
  • Replicate/Fal.ai: AI-powered animation generation
  • RevenueCat: Subscription management and verification
  • Vercel Blob Storage: Temporary image storage

Service availability depends on the reliability of these third-party providers. We are not responsible for outages or issues with third-party infrastructure.

12.3 Updates

  • We may release updates to the App that add, modify, or remove features
  • Backend services may be updated without notice to add features, improve performance, or fix issues
  • You are responsible for keeping the App updated to the latest version
  • Some features may require the latest version of the App and backend services

13. Privacy

Your use of the App is also governed by our Privacy Policy, which can be found at https://remotionapp.com/privacy. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

13.1 Backend Data Handling

  • User data, including app user IDs and credit balances, are stored on our backend servers
  • Images are temporarily stored on backend infrastructure for processing
  • We use secure API authentication to protect access to backend services
  • Credit transactions and usage data are logged on backend systems for service operation
  • Data is stored in compliance with applicable data protection laws

14. Disclaimers and Limitation of Liability

14.1 Service "As Is"

  • The Service is provided "as is" and "as available" without warranties of any kind
  • We do not guarantee that the Service will be error-free, uninterrupted, or secure
  • We do not warrant that the results obtained from using the Service will meet your expectations
  • Backend services are provided without warranty of availability or performance

14.2 Third-Party Services

  • Our backend relies on third-party services (Vercel, Replicate, Fal.ai, Upstash, RevenueCat)
  • We are not responsible for the availability, performance, or reliability of third-party services
  • Issues with third-party providers may affect Service availability
  • We do not guarantee the quality or accuracy of AI-generated content from third-party providers

14.3 Limitation of Liability

To the maximum extent permitted by law:

  • SIA ByteMind shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim
  • We are not liable for any loss of data, content, or profits
  • We are not liable for backend service outages, third-party provider failures, or data loss

14.4 AI-Generated Content

  • Animations and videos generated by the App are created using artificial intelligence
  • Results may vary and may not always meet your expectations
  • We do not guarantee the accuracy, quality, or suitability of AI-generated content
  • AI processing is performed by third-party providers (Replicate, Fal.ai) and subject to their limitations

15. Indemnification

You agree to indemnify, defend, and hold harmless SIA ByteMind, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content
  • Your unauthorized access to or use of backend services

16. Termination

16.1 Termination by You

  • You may stop using the App at any time
  • You may cancel your subscription through your Apple ID account settings
  • Cancellation does not entitle you to a refund for the current billing period

16.2 Termination by Us

We may suspend or terminate your access to the Service if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • You attempt to abuse or exploit backend systems
  • We are required to do so by law
  • We discontinue the Service

16.3 Effect of Termination

  • Upon termination, your right to use the Service immediately ceases
  • We may delete your account, User Content, and associated backend data
  • Credit balances and usage data may be permanently deleted
  • Provisions that by their nature should survive termination will survive

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms in the App
  • Updating the "Last Updated" date
  • Sending a notification through the App (if applicable)

Your continued use of the App after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App and cancel your subscription.

18. Governing Law and Dispute Resolution

18.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Latvia, without regard to its conflict of law provisions.

18.2 Dispute Resolution

  • Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Latvia
  • You agree to submit to the exclusive jurisdiction of the courts of Latvia

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SIA ByteMind regarding the Service and supersede all prior agreements and understandings.

22. Apple-Specific Terms

The following terms apply to users who download the App from the Apple App Store:

22.1 Acknowledgment

  • These Terms are between you and SIA ByteMind, not Apple
  • Apple is not responsible for the App, its content, or backend services

22.2 Apple's Rights

  • Apple has no obligation to provide support or maintenance for the App
  • In the event of App failure, Apple has no warranty obligation
  • Apple is not responsible for addressing any claims related to the App or backend services

22.3 Third-Party Services

  • The App may use third-party services (including RevenueCat) for subscription management
  • Backend services use third-party providers (Vercel, Replicate, Fal.ai, Upstash) for infrastructure and AI processing
  • Your use of these services is subject to their respective terms and conditions

22.4 Intellectual Property

In the event of any third-party claim that the App infringes intellectual property rights, SIA ByteMind, not Apple, will be responsible for investigation, defense, settlement, and discharge.

23. Subscription-Specific Terms

23.1 Monthly Subscriptions

  • Subscriptions are billed monthly in advance
  • Each subscription includes a monthly credit allocation
  • Credits are used to generate photo animations (1 credit per animation)

23.2 Credit Allocation

  • Credits are allocated at the beginning of each subscription period
  • Credit allocation is processed server-side and synchronized with RevenueCat
  • If monthly capacity is reached, credit allocation may be delayed
  • Credits do not accumulate or carry over between billing periods
  • Credit balances are stored and managed on backend servers

23.3 Backend Credit Verification

  • Credit balances are verified server-side for each animation request
  • Credit spending is enforced atomically on the backend before AI processing begins
  • Daily spending limits and monthly capacity limits are enforced on backend servers
  • Credit synchronization with RevenueCat subscriptions is performed server-side

23.4 Subscription Changes

  • We reserve the right to modify subscription pricing with 30 days' notice
  • Price changes will not affect your current billing period
  • You will be notified of price changes before they take effect

24. Backend Service Terms

24.1 API Usage

  • The App communicates with backend services through secure REST APIs
  • API requests are authenticated using secure tokens
  • Rate limiting is enforced on backend servers to prevent abuse
  • Excessive API usage may result in temporary or permanent access restrictions

24.2 Data Processing

  • User images are processed on backend servers using third-party AI providers
  • Processing times may vary depending on server load and AI provider availability
  • We do not guarantee specific processing times or completion deadlines
  • Failed processing attempts may consume credits without generating results

24.3 Service Limits

Backend services enforce daily and monthly limits on:

  • Number of animation jobs per day
  • Total credits spent per day
  • Monthly credit capacity allocation

These limits are enforced server-side and cannot be bypassed. Limits may be adjusted at our discretion to maintain service quality.

24.4 Data Retention

  • User images are temporarily stored on backend servers during processing
  • Processed images and generated videos are stored on third-party CDNs
  • We do not permanently store user images after processing
  • Credit balances and usage data are retained for service operation and billing purposes
  • Account data may be retained after account termination as required by law

24.5 Security

  • Backend services use industry-standard security measures
  • API communications are encrypted using HTTPS
  • Authentication tokens are required for all backend API access
  • We implement rate limiting and abuse prevention measures
  • However, we cannot guarantee absolute security of data transmission or storage
